when i click on the Terms of use to read it the side jumps up to top of the side! I think this is an bug.

Where exactly is the terms link that you are referring to?
I see several links there that simply link to /# – that is just a placeholder and is meant to show the link there, while not actually linking anywhere.
If you want those to actually link to something you’ll have to change them.

Now u see under the Textarea this:

I have read, and agree to abide by the [LINK=#]Website rules.[/LINK]

Now click on Website rules and you can see what i mean. The Site jumps to the top

ahh – I see what you are referring to – did you notice the popup that appears?
A modal appears with the website Terms of Service so people can review them.

Yes,

but after closing the modal i must scroll down back to the Form. that´s the point 😉
